1. Scope and Contracting Parties
These Terms of Service govern the use of the website analyseboard.com, its features, and the associated Twitch Extension "Reincarnation Draft Overlay" (together, the "Service"), operated by the operator of analyseboard.com ("we", "us"; details in the imprint). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
2. The Service
analyseboard.com is a Dota 2 analytics platform. The majority of functions — including the Twitch Extension, which displays public draft information (picks, bans and aggregated statistics) of a Dota 2 match while a broadcaster is casting — are provided free of charge. Certain functions in the "Reincarnation" area are available against payment (see section 3). The Service processes publicly available Dota 2 data and data you provide; details are set out in our Privacy Policy and, for the Extension, in the Extension Privacy Policy. The Service is provided "as is". We do not warrant uninterrupted availability or the accuracy of statistics, and we may change, limit or discontinue features at any time.
3. Prices and Payment
Paid features (the Reincarnation area) are shown with their prices before purchase. Payments are processed by our reseller Paddle.com Market Ltd., acting as Merchant of Record; Paddle's terms apply to the payment transaction. Prices include statutory VAT where applicable. The free features, including the Twitch Extension, require no payment.
4. Term and Cancellation
You may stop using the free Service at any time and may request deletion of your account by an informal message to support@analyseboard.com. Paid subscriptions run for the period stated at purchase and can be cancelled to the end of the current billing period; the specific cancellation terms are shown during checkout. We may suspend or terminate access in the event of a material breach of these Terms or misuse of the Service.
5. Acceptable Use
You agree not to misuse the Service, in particular not to attempt to circumvent access controls, disrupt or overload the infrastructure, scrape or resell data at scale, or use the Service unlawfully. The Twitch Extension may only be used in accordance with Twitch's own terms and policies.
6. Right of Withdrawal (digital content)
For paid digital content, consumers have a statutory right of withdrawal. By expressly consenting to the immediate provision of paid digital content and acknowledging that you thereby lose your right of withdrawal once performance has begun (§ 356(5) BGB), the right of withdrawal lapses. The free features are not the subject of a paid contract. Details are set out in our Refund Policy.
7. Liability, Warranty and Jurisdiction
Statistics and draft data are provided for informational purposes without warranty as to accuracy or fitness for a particular purpose. We are liable without limitation for intent and gross negligence and under mandatory statutory provisions (in particular the German Product Liability Act and for injury to life, body or health). For slight negligence we are liable only for the breach of a material contractual obligation and limited to the foreseeable, typical damage. The Service is not affiliated with, endorsed by or sponsored by Twitch Interactive, Inc. or Valve Corporation; Dota 2 and related marks are the property of Valve. German law applies. Where legally permissible, the place of jurisdiction is the registered seat of the operator.
